Welcome to Tool-to-Fix! These Terms of Service govern your use of the Tool-to-Fix platform, accessible via http://tooltofix.com/ (“Site”). By accessing or using the Site and the services offered, you agree to comply with these Terms of Service. If you do not agree with these terms, please do not use the Site.

1. Acceptance of Terms

By creating an account, accessing the Site, or using any services offered by Tool-to-Fix, you acknowledge that you:

  • Are at least 18 years old or have parental consent to use the Site.
  • Have read, understood, and agree to abide by these Terms of Service.
  • If acting on behalf of a company or legal entity, have the authority to bind that entity to these Terms.

2. Description of Services

Tool-to-Fix provides a platform for Users to connect and facilitate the rental and borrowing of tools for personal and professional use. The services include:

  • Listing tools for rent
  • Facilitating tool reservations
  • Providing a communication channel between lenders and borrowers

Tool-to-Fix does not currently handle payments or provide insurance. All rental arrangements and payments are managed directly between Users.

3. Pilot Phase Disclaimer

Tool-to-Fix is currently operating in a pilot phase. During this period:

  • The platform is offered as a free service.
  • Tool-to-Fix does not process payments or provide insurance coverage.
  • All rental transactions and payment arrangements occur directly between the tool Owner and the Renter.

Future versions of the platform may include features such as integrated payment processing, insurance options, and other services. Users will be notified of any such changes, and updated Terms of Service will apply accordingly.

4. User Accounts

To access certain features, Users must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your login credentials.
  • Be solely responsible for activities under your account.

Tool-to-Fix reserves the right to suspend or terminate accounts for any unauthorized or fraudulent activity.

5. User Conduct

You agree to use the platform responsibly and not to engage in the following prohibited activities:

  • Listing tools that are defective, unsafe, or otherwise unsuitable for rental.
  • Using the platform for illegal purposes or to violate applicable laws.
  • Misrepresenting the condition, availability, or ownership of tools.
  • Transmitting viruses or other harmful code.
  • Listing or renting tools that require special licenses or training unless explicitly permitted by local laws.

Tool-to-Fix reserves the right to remove any content or accounts that violate these Terms or applicable laws.

6. Tool Listings and Transactions

Tool Owners:

  • Must provide accurate descriptions, photos, and pricing for tools listed.
  • Agree to maintain tools in safe, working condition.
  • Are responsible for ensuring tools meet applicable safety standards.

Renters:

  • Agree to inspect tools upon receipt and report any issues immediately.
  • Must use tools responsibly and return them in the same condition as received.
  • Are responsible for any damage caused during the rental period.

Tool-to-Fix is not involved in payments, insurance, or condition guarantees. All financial and legal responsibilities lie with the Users. Disputes regarding rentals, damage, or payments must be resolved directly between the involved Users.

7. Dispute Resolution

Tool-to-Fix encourages Users to resolve disputes independently. If needed, Tool-to-Fix may, at its discretion, facilitate communication between parties, but is not obligated to intervene. Tool-to-Fix is not responsible for resolving payment or tool condition disputes.

By using the platform, you agree that any unresolved disputes shall first be attempted through informal resolution and, if necessary, resolved through arbitration before resorting to legal action.

8. Limitation of Liability

Tool-to-Fix is a platform facilitator and is not responsible for:

  • The condition, safety, or performance of tools.
  • Losses, damages, or injuries caused by the use of rented tools.
  • Any disputes or disagreements between Users.
  • Payment or transaction issues.

Tool-to-Fix’s liability is limited to the maximum extent permitted by law.

9. Intellectual Property

All content and materials on the Site, including but not limited to logos, trademarks, text, graphics, and software, are the property of Tool-to-Fix or its licensors. Users may not reproduce, distribute, or modify these materials without prior written consent.

10. Privacy

Your use of the platform is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Site, you agree to the terms of the Privacy Policy.

11. Termination

Tool-to-Fix reserves the right to suspend or terminate your account or access to the platform at any time, without prior notice, for:

  • Breaches of these Terms of Service
  • Fraudulent or illegal activities
  • Actions that harm the reputation or integrity of Tool-to-Fix

12. Modifications to Terms

Tool-to-Fix reserves the right to update these Terms of Service at any time. Significant changes will be communicated to Users, and continued use of the platform after updates constitutes acceptance of the revised Terms.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.
